I
have read many reports about the removal of linda ikeji from the blogging
community. This is a sad news considering how much she has invested in building
that blog to its present state before the removal.
Before
Linda’s removal, she blamed her enemies and one Mr.AyeDee who reportedly instigated google
to remove her blog, but in my view, such may not be the way to go, as such
claims by Linda may be misleading the public on what actually led to her
removal.
Lately, the site has been hit by multiple allegations of plagiarism with critics allegedly prodding Google to suspend the blog.
Although, Linda denies lifting materials without proper attribution, but that claim from Mr.rights investigation seems to be false.
According to Linda, one Aye Dee 15Past8 has been working on her down fall. She said Mr. Dee and other tech-savvy publishers were out to have her website suspended by Google, angered by her success.
First,
we must take a cerful look at the facts before passing judgement on any
individual, this is necessary to avoid blaming the wrong person for what I
perceived to be a self inflicted tragedy.
While
It may be true that Aye Dee may have instigated goog le to act against Linda
for using his content without reference, but certainly, this fellow has no
influence over googles decision.
Having
read that Linda was indeed removed by google after many days of rumor, it
occure to me that Linda might also be guilty and as a result, inflicted these
situation on herself.
From
my investigation, It is practically impossible for google to remove Linda
Ikeji’s blog because of this particular accusation by Aye Dee, this is not
inline with google’s policy.
Googles copyrights policy states
that, ‘’when we receive proper notice as required by Digital Mellenium
Copyright Acts (DMCA), we will work to promptly remove content that has been
identified as copyright infringement. Repeate infringers blog are removed, and
in appropriate instances bloggers account will be terminated.
In general, any original work of
authorship may be protected by copyrights. Copyrighted materials may be subject
to claims of copyright infringement. The most common reason we take down
content from blogs for copyrights infrigement is that they have published
republished unauthorized copies of copyrighted content and the owner of the
copyrighted content have alerted us that their content is being used without
their permission. Google states.
Explaining further on how it
works, Googles term of agreement on the consequences of uploading copyrighted
material states that, ‘’anytime google is properly notified that a blog or any
part of a blog on our site infrings the copyrights of a third party,we will
take it (the particular content)down from the site as required by law’’.
From
the above, it should be noted that, google don’t just take down a whole blog
for one or two content copy right, what they simply do is to remove that
particular post or content reported for copyright infringement.
As
a means of check to protect the blogger such as Linda, google also states that,
‘’if you believe we’ve removed content from your blog in error and that you are
the copyright owner or have permission, you can file a counter notice and let
us know. The decision to remove the post from your blog would be reversed if
comfirmed and the post would be returned back to your blog.
Here
we see that, google don’t just remove content from one’s blog, they also give
you the opportunity to correct error.
The
case of Linda is different, a post or content wasn’t removed from her blog this
time, her whole blog was tarminated. This is where we all must see that Linda
may delibrately be misleading the public by tagging this as work of some
enemies. To me, it seems like a self inflicted vice.
According
to google term, before a whole blog would be deleted or removed, certainly,
many warnings might have been made. Several content must have been removed
serving as a warning to the blogger that a graver consequence might folow if
infringement is not stopped.
The
google term states also that, ‘’Accounts determined to be repeat infringers may
be subject to termination’’.
‘’Our
current repeat infringer policy counts strikes by 24-hour periods. For example,
if 5 blog posts were removed under the digital millennium copyrights act (DMCA)
today, those removals would count as 1 strike. If 3 more posts were removed on
the following day, those would count as 1 additional strike, totalling 2
strikes against that blogger’s account. Multiple strikes will be evaluated and
may result in further remedial action, including deletion of the blog and or
terminating the account’’.
From
the above, it could be seen that, before google would delete or remove Linda
Ikeji’s blog, several copyright content must have been removed, which serves as
warning. If done in error, Linda was expected to file a counter notice then,
but from the look of things, she didn’t which means she might somehow be
guilty.
After
many contents were removed from her blog as a result of copyright infringement,further
copyright content should have been avoided, but persistent infringment may have
led to Linda’s complete removal.
This
has nothing to do with the perceived enemy Linda has been describng prior to
her removal.
It
is important to note that, while I do not know Linda or the individual in
question, it is important that we focus on issues rather than personality
attack.
We
shouldn’t be blaming every situation on perceived enemies when such situation
could be avoided with sincerity and a little more caution.
If
Linda isn’t guilty of the infringement, she should file a counter notice and if
evaluated and comfirmed to be true, her blog would certainly be returned.
She
also have the option of sueing google for claims. If she is sure it was removed
in error, she can actually sue google and claim huge returns if proven
innocent.
Google’s Manager for
Communications and Public Affairs, Anglo-Phone West Africa, Taiwo
Kolade-Ogunlade, in a chat with Punch newspaper said,
“Google as an organisation takes issues of copyright seriously and belongs
to a group of digital companies that respect copyrights.“Copyright is a big deal and this is why you can’t just go and pick up another person’s intellectual property or content and lay claim to its ownership.
“It is not a case of witch-hunting and has nothing to do with Linda Ikeji’s personality or anyone else because there is a process, and irrespective of who you are in the world, that process would apply to you.
“It has become imperative for online entrepreneurs to respect the rights of copyright holders noting that the Internet community should be built on mutual trust and general respect.
“Let’s respect other people’s rights and intellectual property. Making money off other people’s content without permission is wrong. Although the Internet is inanimate, it is the content on it that gives it life. These are the issues.
“Whenever owners of online contents come after you accusing you of using their content, it is because they have families to feed and businesses to sustain.
“People should also understand that copyrights does not only apply to text, but also extends to literary works, images and photographs, music files and MP3s, movies, movie trailers and videos as well as software”, Kolade-Ogunlade explained.
